TERMS AND CONDITIONS OF YOUR BOOKING

This document governs the conditions applicable to all reservations of tourist accommodation managed by Escape Home. Acceptance of these Terms and Conditions is an essential requirement to formalize the booking.

Please read these Terms carefully, as they contain important information regarding your legal rights and obligations.

 

  1. Definitions.

For the purposes of this document, the following terms shall have the meanings set forth below:

 

  • Client: Natural person or legal entity holding the reservation, over EIGHTEEN (18) years of age at the time of the check-in, with legal capacity to contract and responsible for all Guests included in the booking.
  • Guests: The Client and all persons listed in the reservation who will stay at the Property.
  • Property: The tourist accommodation (villa, house, apartment, or other) managed by Escape Home and subject to the Reservation.
  • Reservation: Group of Guests that includes at least one adult over EIGHTEEN (18) years if age and is not composed exclusively of individual under that age.

 

  1. Requirements to Formalize a Reservation.

To make a Reservation, the Client must:

a)      Be over EIGHTEEN (18) years of age at the time of check-in.

b)     Have the authority and legal capacity to contract.

c)      Fully accept these Terms and Conditions.

d)     Guarantee the accuracy and truthfulness of the information provided to Escape Home and agree to notify any changes to such information.

 

  1. Mandatory Guest Information and Occupancy Limit.

Prior to arrival, during the online check-in process and in compliance with Royal Decree 933/2021(Spain), the Client must provide Escape Home with the following details for all Guests as required by applicable law:

  • Full name
  • Gender
  • Identity document number, document support number, or passport
  • Date of birth
  • Nationality
  • Place of habitual residence
  • Landline and/or mobile phone number
  • Email address
  • Degree of kinship (for minors)

For security reasons and in compliance with current regulations, Escape Home reserves the right to verify Guest identities at the moment of check-in.

The number of Guests may not exceed the maximum capacity indicated in the booking confirmation. Overnight stays by persons not listed in the Reservation are strictly prohibited. Failure to comply may result in immediate cancellation of the Reservation without refund or additional charges for extra persons, according to current rates.

 

  1. Cancellation Policy.

 

4.1.           Cancellation by the Client.

Cancellation fees as indicated and accepted in the booking confirmation will apply.

4.2.           Early Departure.

No refund will be issued if the Client voluntarily vacates the Property before the scheduled departure date.

 

  1. Check-In and Check-Out Times.

The Property will be available from 16:00 on the arrival date for check-in and must be vacated by 10:00 on the departure date for check-out. Failure to comply may result in additional charges.

 

  1. General Rules for Use of the Property.

 

a)      Guests Under Age.

Groups composed exclusively of minors will not be accepted without the presence of at least one adult over EIGHTEEN (18) years of age staying at the Property. At least one adult over EIGHTEEN (18) years of age must be accommodated at the time of check‑in, and this person must also be the Client Reservation Holder. If a reservation made exclusively by individuals under EIGHTEEN (18) years of age is detected, it will be cancelled immediately upon detection with no possibility of refund.

 

 

b)     Property Cleaning.

The Property will be delivered clean, with prepared beds and one set of towels per Guest.

For stays of TEN (10) nights or more, our staff will perform a partial cleaning of common areas and bathrooms, as well as change bed linen and towels. Guests must grant explicit access for this service. If you do not wish to receive this service, please notify us at least TWO (2) days in advance.

The Client must leave the Property in a reasonably clean condition. Each Property has an estimated cleaning time to prepare it for the next Guests. If a significantly greater cleaning effort is required, Escape Home may apply additional charges and, if this delays the check-in of subsequent Guests, a penalty of ONE HUNDRED EUROS (€100.00) per booking will be imposed. In addition, the Client must dispose of all garbage in the nearest containers before departure.

c)      Garden and Pool.

Garden and pool maintenance will be carried out by personnel authorized by Escape Home, who may access the outdoor areas of the Property for these tasks.

d)     Express Prohibitions.

  1. Moving the Property’s furniture from its original location.
  2. Any acts causing damage to furniture, fixtures, or items within the Property. In such cases, Escape Home may require Guests to vacate the Property within a maximum of 24 hours.
  3. Smoking inside the Property. If the cleaning service finds evidence of non-compliance with this provision, the cost of any resulting damage (including additional cleaning for odor removal) will be charged to the Client named on the Reservation. Escape Home may also require Guests to vacate the Property within 24 hours.
  4. Bringing animals onto the Property. If the cleaning service finds evidence of non-compliance, the cost of any resulting damage will be charged to the Client named on the Reservation. Escape Home may also require Guests to vacate the Property within 24 hours.
  5. Organizing parties or events that disturb neighbors or violate Law 1/2025 of June 13 (Spain). In such cases, Escape Home may require Guests to vacate the Property within TWENTY-FOUR (24) hours, without refund, and report the incident to the authorities.
  6. Playing music or making noise at a volume that disturbs neighbors. If authorities or third parties intervene, a penalty of ONE HUNDRED EUROS (€100.00) per night and per Reservation will apply. Escape Home may also require Guests to vacate the Property within 24 hours.
  7. Any conduct that may constitute a criminal offense as determined by authorities or that poses a danger or risk of injury to any Guest. Escape Home may require Guests to vacate the Property within 24 hours.

 

e)      At Check-Out.

The Client must leave the Property locked and with all lights turned off.

f)       Inspection Authorization

Guests expressly authorize Escape Home staff or subcontracted personnel to access the Property for inspection in the event of a well-founded suspicion of misuse.

 

7. Security Deposit

a)      Exemptions.

No security deposit will be required for Reservations (see Section 1: Definitions), except in case of Guests aged between EIGHTEEN (18) and TWENTY-SIX (26) years old. In such cases, the applicable amounts shall be as follows:

  1. ONE HUNDRED FIFTY EUROS (€150.00) per Guest: Applicable throughout the year, except during the periods listed below.
  2. ii. THREE HUNDRED EUROS (€300.00) per Guest: For stays during local holidays, including Pentecost, San Juan holidays, Puerto del Carmen holidays, Famara holidays, Carnavales, Punta Mujeres holidays and Virgen de los Dolores holidays.

Furthermore, no security deposit will be required for Reservations made by families with minors, even when the group includes Guests aged between EIGHTEEN (18) and TWENTY‑SIX (26) years old.

b)     Payment.

The security deposit must be paid prior to arrival by credit card in the name of the Client, for each Guest aged between EIGHTEEN (18) and TWENTY‑SIX (26) years old.

c)      Refund and Deductions.

The security deposit will be refunded in full after the check-out inspection, provided there is no damage or breach of these Terms.

Otherwise, the following costs will be deducted directly from the deposit:

  • Cost of damages or replacements (according to the service provider’s or Owner’s invoice).
  • Penalty for disturbances or rule violations: ONE HUNDRED EUROS (€100.00) per night and per Reservation.
  • Whenever any amount is withheld or deducted from the deposit, an additional FIFTY EUROS (€50.00) per Reservation will be charged as Escape Home’s administrative fee.

 

8. Right of Admission.

Escape Home reserves the right of admission and may refuse Reservations from Clients previously expelled for violating these Terms and Conditions, without the need to justify such decision. Escape Home’s primary goal is to ensure safety, well-being, and proper coexistence in its managed accommodations.

 

9. Grounds for Immediate Expulsion from the Property.

Escape Home may require Guests to vacate the Property immediately, without refund, in the following cases (in addition to those listed in Section 6.d):

a) Groups composed exclusively of minors.

b) Conduct that endangers the physical integrity of people.

c) Violation of Law 1/2025 (Spain) or community rules.

 

10. Change of Accommodation Due to Force Majeure.

If Escape Home cannot provide the reserved Property due to force majeure (serious breakdown, construction work, urgent sale, severe damage caused by third parties, etc.), an alternative Property of equal or higher category will be offered at the same price whenever possible.

If no alternative is available, the amount corresponding to unused nights will be refunded.

Escape Home will cover relocation and transportation costs at no additional charge to the Client.

 

11. Limitation of Liability.

Escape Home shall not be liable for:

  • Loss, theft, or damage to personal belongings during the stay.
  • Inconveniences caused by circumstances beyond Escape Home’s control (power or water outages, public works, adverse weather conditions, etc.).
  • Injuries or accidents resulting from improper use of facilities.

The Client is responsible for supervising minors and dependent people at all times.
